This Privacy Policy describes how Buildable, Inc. ("Buildable," "we," "us," or "our") collects, uses, and shares information when you visit or use simplybuildable.com (the "Site") and the tools and services we make available on the Site, including the build cost calculator, the renovation cost calculator, the construction loan calculator, the consultation booking flow, and the agent page (collectively with the Site, the "Services").

This Privacy Policy is incorporated into and forms part of our Terms of Service. By using the Services, you agree to the practices described in this Privacy Policy.

The Services are intended for U.S. residents who are at least 18 years old. The Services are not directed at children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, contact us at nick@simplybuildable.com and we will delete it.

1. Information We Collect

We collect information you provide directly to us, information we collect automatically when you use the Services, and information we receive from third parties.

1.1 Information You Provide

When you contact us, request a consultation, book a consultation, use any calculator, contact us as a real estate agent, or otherwise communicate with us through the Services, we may collect:

  • Name

  • Email address

  • Phone number (mobile or landline)

  • Mailing address or property address

  • Information about your project, including budget, timeline, lot details, square footage, design preferences, and any other details you choose to share

  • Calculator inputs, including build size and finish level (build cost calculator), renovation scope and existing home details (renovation cost calculator), and financing details such as down payment, loan amount, and loan term (construction loan calculator)

  • Scheduling information, including the date and time you select for a consultation

  • Real estate license information and brokerage affiliation, if you contact us as a real estate agent

  • Any other information you submit through forms, the calculators, the booking flow, or direct communication

We refer to this as "Inquiry Information."

The construction loan calculator collects financial details such as down payment amount, loan amount, and loan term. Buildable is not a lender and does not use this information to make any lending decision or share it with lenders. It is used only to generate calculator output for you, with the disclaimers described in our Terms of Service.

When you provide a phone number through the Services, you may receive both transactional and marketing communications from us, including phone calls and SMS text messages, as described in Section 2 below.

1.2 Information We Collect Automatically

When you use the Services, we automatically collect certain information about your device and how you interact with the Site, including:

  • IP address

  • Browser type and version

  • Operating system

  • Time zone and approximate location

  • Pages viewed, time spent on pages, and links clicked

  • Calculators used and inputs entered

  • Referring website or search terms that brought you to the Site

  • Date and time of your visit

  • Cookies and similar tracking technologies (see Section 4)

We refer to this as "Device Information."

1.3 Information from Third Parties

We may receive information about you from third parties, including:

  • Analytics and behavior tracking providers (such as Google Analytics and Hotjar)

  • Advertising platforms (such as Google Ads, Meta, and others)

  • Search and mapping services (such as Google Search Console and Google Maps API)

  • Customer relationship management tools we use to manage inquiries

  • Form and scheduling providers we use to collect submissions and manage bookings (such as Typeform and Calendly)

  • Email marketing providers (such as Mailchimp)

  • Public sources, such as property records, when relevant to evaluating a project

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiries and provide the consultations or estimates you request

  • Generate output from the build cost calculator, renovation cost calculator, and construction loan calculator

  • Send you the results of any calculator submission or inquiry by email, including written estimates, project information, and follow-up communications related to your request

  • Schedule, confirm, and manage consultation appointments

  • Communicate with you about your project, our services, and your appointments

  • Add you to our marketing communications, including newsletters, project updates, educational content, and ongoing nurture sequences about Buildable's services

  • Improve and optimize the Services

  • Analyze usage patterns and measure the effectiveness of our marketing

  • Detect, prevent, and address fraud, security issues, or abuse of the Services

  • Evaluate referral or working relationships with real estate agents who contact us

  • Comply with legal obligations and enforce our Terms of Service

How Calculator and Form Submissions Are Used

When you submit information through one of our calculators or contact forms, you are requesting an estimate or other response from Buildable. We will use the information you submit to:

  • Generate and send you the requested estimate or response by email

  • Follow up with you by email, phone, and text message about your project, including additional information, related estimates, scheduling a consultation, and answering questions

  • Add you to our ongoing marketing communications, including educational content, project updates, and information about Buildable's services that we believe may be relevant to your inquiry

Consent to Phone, Email, and SMS Communications

By submitting your contact information through the Services and providing your phone number, you provide your prior express written consent under the federal Telephone Consumer Protection Act (47 U.S.C. § 227) and applicable state laws for Buildable to contact you by:

  • Email at the email address you provide

  • Phone calls at the phone number you provide, including calls placed using an automatic telephone dialing system or a prerecorded or artificial voice

  • Text messages (SMS and MMS) at the phone number you provide, including messages sent using an automated system

These communications may include responses to your inquiry, requested estimates, scheduling and appointment information, follow-up about your project, and marketing communications about Buildable's services.

Consent to receive calls and text messages is not a condition of purchasing any goods or services. Standard message and data rates from your carrier may apply. Message frequency varies based on your activity and inquiry.

You may opt out of:

  • Marketing emails by following the unsubscribe link in any marketing email (managed through Mailchimp) or by emailing nick@simplybuildable.com

  • Marketing text messages by replying STOP to any text message, or by emailing nick@simplybuildable.com with "STOP" in the subject line

  • Marketing phone calls by telling the caller you wish to opt out, or by emailing nick@simplybuildable.com

Replying STOP to any text will stop further marketing texts but will not affect transactional messages related to a specific inquiry, estimate, or appointment you have requested. Reply HELP for help, or contact us at the email or phone number listed in Section 11.

Opting out of marketing communications will not stop transactional communications related to a specific inquiry, estimate, or appointment you have requested. To stop all communications, including transactional, contact us directly at nick@simplybuildable.com.

3. How We Share Your Information

We share your information only as described below.

3.1 Service Providers

We share information with third-party service providers that help us operate the Services and our business. These include:

  • Squarespace as our website host and platform provider

  • Typeform for collecting form submissions, including consultation requests, calculator inputs, and other inquiry forms

  • Calendly for the consultation booking flow, including scheduling, confirming, and managing appointments

  • Zoom for conducting virtual consultations, when consultations take place by video

  • Follow Up Boss for managing customer relationships and inquiries

  • Mailchimp for managing email marketing communications and newsletter subscriptions

  • Google services, including Google Analytics (for understanding how visitors use the Site), Google Ads (for marketing and retargeting), Google Tag Manager (for managing tracking tags), Google Search Console (for monitoring Site performance in search), Google Workspace and Gmail (for sending and receiving email correspondence with you), and Google Maps API (for displaying location and service area information). Your information may be processed by Google as part of these services, subject to Google's privacy policy at policies.google.com/privacy

  • Hotjar for understanding how visitors interact with the Site through session recordings, heatmaps, and behavior analytics (see Section 3.1.1 below)

  • Meta, Reddit, and other advertising platforms for marketing and retargeting

These providers are authorized to use your information only as needed to provide services to us. Each provider has its own privacy policy, which governs how they handle your information.

3.1.1 Session Recording and Behavior Analytics

We use Hotjar to better understand how visitors use the Site. Hotjar records information about your interaction with the Site, including mouse movements, clicks, scroll behavior, pages visited, and information you enter into forms. Hotjar applies masking by default to sensitive form fields (such as password fields), and we have configured Hotjar to suppress the recording of free-text fields where you enter personal information. Hotjar does not collect information that directly identifies you. You can opt out of Hotjar tracking at any time by visiting hotjar.com/legal/compliance/opt-out.

3.1.2 Virtual Consultations

If you book a consultation that takes place by video, the consultation will be conducted using Zoom. Zoom processes audio, video, and chat data during the meeting. We do not record consultations without your explicit consent, which we will request at the start of any consultation we propose to record.

3.2 Legal Requirements

We may share your information if we believe in good faith that disclosure is necessary to:

  • Comply with applicable law, regulation, subpoena, court order, or other legal process

  • Protect the rights, property, or safety of Buildable, our users, or the public

  • Detect, prevent, or address fraud, security, or technical issues

  • Enforce our Terms of Service or other agreements

3.3 Business Transfers

If Buildable is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such transfer through a notice on the Site.

3.4 With Your Consent

We may share your information for any other purpose with your consent.

We do not sell your personal information for money. We do not share construction loan calculator inputs with any lender. Note that under California law (CCPA/CPRA), some sharing for advertising purposes may technically qualify as a "sale" or "sharing" of personal information. See Section 7 for your California rights, including the right to opt out.

4. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, understand how it's used, and deliver relevant advertising.

Strictly necessary cookies allow basic Site functionality (such as remembering your form inputs).

Analytics and behavior cookies help us understand how visitors use the Site (such as Google Analytics, which provides aggregated usage data, and Hotjar, which records sessions and creates heatmaps to show how users interact with pages).

Advertising cookies allow us and our partners to deliver targeted advertising and measure its effectiveness, including retargeting users who have visited the Site on platforms such as Google, Meta (Facebook and Instagram), Reddit, and similar networks.

You can manage cookies through your browser settings. Most browsers let you refuse cookies, delete cookies, or alert you when cookies are being placed. Disabling cookies may affect some Site functionality. For more general information about cookies, visit allaboutcookies.org.

5. Targeted Advertising and Your Choices

We work with third-party advertising platforms to show you ads about Buildable on other websites and apps. These platforms use cookies, web beacons, and similar technologies to deliver and measure ads.

Do Not Track

Some browsers offer a "Do Not Track" signal. Because there is no consistent industry standard for honoring this signal, we currently do not respond to Do Not Track signals.

6. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or electronic storage is fully secure, however, and we cannot guarantee absolute security. You share information with us at your own risk.

7. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA") give you certain rights regarding your personal information.

7.1 Categories of Information We Collect, Use, and Share

In the past 12 months, we have collected the following categories of personal information, as defined by the CCPA/CPRA:

  • Identifiers (name, email, phone number, IP address, mailing address)

  • Customer records (information you provide about your project, calculator inputs, scheduling details)

  • Professional or employment information (real estate license information, if you contact us as an agent)

  • Internet or network activity (browsing history on the Site, calculator usage)

  • Geolocation data (approximate location based on IP address)

  • Inferences drawn from the above (such as preferences and interests)

We collect this information from the sources described in Section 1, use it for the purposes described in Section 2, and share it with the categories of recipients described in Section 3.

We do not sell personal information for money. We may share personal information with advertising partners for cross-context behavioral advertising, which may qualify as "sharing" under the CPRA. You have the right to opt out of this sharing (see Section 7.2).

We do not knowingly sell or share the personal information of consumers under 16 years old.

7.2 Your Rights

As a California resident, you have the right to:

  • Know what personal information we collect, use, and share about you

  • Access the specific pieces of personal information we have collected about you

  • Delete the personal information we have collected, subject to certain exceptions

  • Correct inaccurate personal information we maintain about you

  • Opt out of the sharing of your personal information for cross-context behavioral advertising

  • Limit the use of sensitive personal information (we do not currently use sensitive personal information for purposes beyond what is allowed without opt-in)

  • Non-discrimination for exercising any of these rights

7.3 Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA or CPRA. This means we will not deny you services, charge you a different price, provide you a different level of service, or otherwise treat you differently because you exercised your privacy rights. We do not offer financial incentives in exchange for personal information.

7.4 How to Exercise Your Rights

To exercise any of these rights, contact us at nick@simplybuildable.com or 1405 Ferrara Ct, Escondido, CA 92025. We will need to verify your identity before responding, which may require us to ask for additional information. We will respond within the timeframes required by California law (generally 45 days, with possible extension).

You may also designate an authorized agent to make a request on your behalf. We will require proof of authorization.

8. Data Retention

We keep your information for as long as needed to provide the Services, respond to your inquiries, comply with our legal obligations, resolve disputes, and enforce our agreements. Inquiry Information related to a consultation request, scheduled appointment, or calculator session is generally retained until you ask us to delete it or until it is no longer needed for our business purposes. Device Information collected through analytics is generally retained for the period set by the analytics provider (typically 14 to 26 months for Google Analytics).

You may request deletion of your information at any time using the contact information in Section 11.

9. Children's Privacy

The Services are not directed at children under 13, and we do not knowingly collect personal information from children under 13. The Services are also intended for users who are at least 18 years old, consistent with our Terms of Service. If you are a parent or guardian and believe we have collected information about your child, contact us at nick@simplybuildable.com and we will delete it.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on the Site and update the "Last Updated" date at the top. If we make material changes, we will provide additional notice (such as a banner on the Site or an email if we have your address). Your continued use of the Services after the effective date of the updated Privacy Policy means you accept the changes.
